The Complexities of West Virginia Adoption Law
The path to adoption is lined with legal intricacies that can vary significantly depending on the circumstances of the child, the birth parents, and the adoptive parents. West Virginia law governs everything from necessary background checks and home studies to the termination of birth parents’ rights and the finalization hearing.
Attempting to manage this complex process without proper legal advice can lead to delays, errors in documentation, and, in some cases, the disruption of the adoption plan. These issues can be emotionally and financially taxing.
Our firm provides clear, steady guidance to help clients:
- Understand Statutory Requirements: We help you meet every provision of the West Virginia Code relevant to your specific adoption type, ensuring all mandatory criteria are fulfilled.
- Manage Documentation: The volume and precision of legal documents, consents, and affidavits required are substantial. We manage the preparation and timely filing of all necessary paperwork with the appropriate courts.
- Navigate Court Procedures: From the initial petition to the final hearing, we represent your interests, helping you understand what to anticipate in court and advocating for the secure placement of the child.
- Address Parental Rights: In many adoptions, a crucial step involves the legal termination of birth parents’ rights, which must be executed perfectly according to law to ensure the final adoption order is legally sound and permanent.
Our team has a concentrated practice in this vital area of family law, giving us the background and procedural knowledge required to manage these sensitive issues with precision and care.
Types of Adoptions We Handle in West Virginia
Our West Virginia adoption attorneys provide strong legal assistance to adoptive parents for all types of adoptions, addressing the unique legal requirements of each category:
Third-Party and Domestic Adoptions
These adoptions often involve an agreement between the adoptive parents and the birth parents (or guardians), often facilitated by an adoption agency or attorney.
- Legal Focus: Our work includes drafting compliant adoption agreements, reviewing agency contracts, securing necessary consents, and ensuring adherence to the Interstate Compact on the Placement of Children (ICPC) requirements, if applicable. We manage the delicate balance of the legal needs of both parties to facilitate a smooth, lawful transfer of custody and rights.
Stepparent and In-Family Adoptions
These are common adoptions where a child is adopted by a current spouse or a relative (such as a grandparent, aunt, or uncle).
- Legal Focus: While often simpler procedurally, these still require careful handling of parental rights termination (especially regarding a non-custodial parent). We assist clients in navigating the legal requirements for consent or, if necessary, petitioning the court for involuntary termination of parental rights based on abandonment or failure to support. For relative adoptions, we help establish the child’s stability and best interest within the existing family structure.
Foreign Adoptions
Parents who have adopted a child in another country often require a subsequent legal action in West Virginia to finalize the adoption or “readopt” the child under U.S. and state law.
- Legal Focus: We assist in the process of ensuring that a foreign adoption decree is recognized in West Virginia, or we guide clients through a full readoption process, which provides certainty under state law and facilitates administrative procedures such as obtaining birth certificates.
Open and Closed Adoptions
These terms define the level of contact and communication between the adoptive family, the adopted child, and the birth family after the adoption is finalized.
- Legal Focus: Whether the arrangement is fully closed (no contact) or open (with agreed-upon communication), we help clients draft and formalize any necessary post-adoption contact agreements. While these agreements are not always legally enforceable to the same degree as final adoption decrees, we ensure they are clearly written and reflect the intentions of all parties involved to minimize future disputes.
Adult Adoptions
Adopting an adult is a simplified process, typically used to formalize a parental relationship with an individual over the age of 18, often for inheritance purposes or emotional recognition.
- Legal Focus: We manage the preparation and filing of the necessary paperwork, which generally requires only the consent of the adult being adopted and the adoptive parent(s), simplifying the court’s role.

How Does Adoption Work in West Virginia?
Under West Virginia law, there are many pathways available for you to adopt a child. These include:
Adopting an Infant
It involves adopting an infant through a licensed private adoption agency, a lawyer, or any other intermediary.
Adopting a Child in Foster Care
It involves adopting a foster child who is under the care of the West Virginia Department of Health and Human Resources.
Foster to Adopt
It is slightly different from traditional adoption. Under the foster-to-adopt method, the court will place a foster child (who is under the care of the West Virginia Department of Health and Human Resources) in your home. Once the child becomes eligible for adoption, you can choose to adopt them legally.
Apart from this, there are also options available for you to adopt a child from one of your family members. These include step-child adoption and grandchild adoption.
Adopting through State vs. Private Agency
It’s noteworthy that the West Virginia Department of Health and Human Services mostly has special needs children under their care. These children typically tend to be older, belong to ethnic or racial minority groups, or have physical or mental problems.
Eligibility Criteria to Become an Adoptive Parent in West Virginia
- You must be a US citizen.
- You must be at least 21 years of age and must be at least 15 years older than the child you want to adopt.
- You must be in good health (physically as well as mentally) and must have the emotional maturity and capacity to care for a child.
- You must have a stable source of income and must be capable of caring for the child you want to adopt.
- You must not have any felony convictions on your record.
- If you and your spouse are both earning members of your family, you must be able to provide the necessary childcare arrangements.
- All members of your household (except children under the age of 12) must express their consent for the adoption.
- You must prove that you can provide a stable and nurturing home for the child.
- You must complete a home study.
Steps Involved in the West Virginia Adoption Process
To begin with, you should fill out the adoptive/foster parent inquiry form (which you can find here) and register as an adoptive or foster parent. The second step involves attending an adoption orientation session, which is meant to educate you on your rights and responsibilities as an adoptive or foster parent.
The third step involves a home study, which will be conducted by a social worker. The social worker will inspect your home, interview you and your family members, evaluate your family’s financial resources, check out a minimum of five references, and review your medical reports, criminal background check reports, and protective services reports. Based on the information, the social worker will decide whether your home is safe and comfortable for the child.
If your home is deemed to be fit for the child in question, you will receive a notification of approval, following which the child will be placed in your home. The law requires the child to be placed in your home for a minimum of six months consecutively before the adoption process can be finalized.
