Jason P. Foster
Jason is a native of Morgantown, West Virginia. Upon graduating from the United States Naval Academy with a Bachelor of Science in Ocean Engineering in 1998, he served six years on active duty in the U.S. Navy as a surface warfare officer. Shortly after Jason was honorably discharged, he began his legal studies at the West Virginia University College of Law, graduating in 2007.
Jason started his legal career at a West Virginia-based national defense firm where he focused his practice on energy litigation, defending first-party insurance cases, and personal injury matters. During his time as a defense attorney, Jason represented a coal company that operated an impoundment that began to fail because another coal company was undermining the impoundment. Through his knowledge of the controlling statutes, regulations and common law, Jason was able to drive the matter to a fair resolution. Jason was also part of a team that defended a national insurance company in first-party bad faith case that culminated in a two-week trial resulting in a defense verdict. Additionally, he successfully represented a multi-jurisdictional SWAT team in a civil rights action stemming from a night-time operation at the home of a suspected armed kidnapper.
In 2016, Jason went to work for a prominent personal injury law firm located in Charleston, West Virginia. There, he represented injured West Virginians and their families in workplace accidents involving the chemical, natural gas and mining industries, complex product liability actions, and other catastrophic personal injury cases. As a plaintiff’s attorney, Jason has represented the family of a man killed in a highly technical and scientific case involving a chemical plant explosion, the family of a coal miner who died as a result of the company’s failure to adhere to the mine’s roof support plan, and the family of a young man who was killed by an excavator on a natural gas well drilling site. Jason also represented a woman who was rendered paraplegic when the seatback of her vehicle failed in a minor rear-end collision in a product liability action against the manufacturer. He also brought a successful suit against a national ATV manufacturer on behalf of a New Jersey family that was injured on the Hatfield-McCoy ATV Trail System when the A-arm on their ATV buckled during normal use resulting in a near-fatal crash. Jason was also part of a team of attorneys who represented the Central West Virginia Regional Airport Authority against numerous defendants in a complex commercial case involving a failed runway safety area and arrestor system.
In his work as both a defense and plaintiff’s attorney, Jason has handled case from the routine to the highly complex from intake, through discovery, to trial and through appeals before both Supreme Court of Appeals of West Virginia and the U.S. Court of Appeals for the Fourth Circuit.
